2. Eligibility

This course is intended for individuals with some prior experience working with clay. While beginner-level experience is acceptable, it is required that participants have some practical knowledge of using clay (water/oil based) and clay sculpting tools. The specific forms or styles previously worked with are not critical for eligibility.

Participants are required to be in sufficient physical and sensory condition to engage in the activities of sculpting. While accommodations can be made for certain disabilities, it is the participant’s responsibility to assess their ability to safely perform the tasks involved. Please contact us prior to enrollment if you have concerns about your ability to participate.

We reserve the right to decline a participant if we determine that their disability would prevent safe or effective participation in the course. If a participant fails to inform us of their condition beforehand and attends despite being unable to safely engage in the activities, we are not liable for any resulting injuries or damages, we reserve the right to deny entry, and no refund will be issued.

3. Payment Terms

• Course Fees: Details on total course fees, payment methods, and deadlines.
• Late Payments: Any penalties or conditions for late payments.

4. Refund and Cancellation Policy

Cancellation by Participant

Participants must provide notice of cancellation at least 30 days prior to the course start date for a full refund. Cancellations made later than 30 days will result in a full refund only if another participant fills the spot; otherwise, a 75% refund of the total fees paid will be issued. No refunds will be given for cancellations made less than 7 days before the course start date.

Cancellation by Organizer

Maudie Brady Art reserves the right to cancel or reschedule the course due to unforeseen circumstances. In such cases, participants will be notified, and a full refund will be issued.

Non-Refundable Deposit

There will be a non-refundable deposit requested upon approval of the participants application. The final balance will be due 2 months in advance of the course start date.

5. Liability and Waivers

Assumption of Risk

Participants acknowledge that they are voluntarily engaging in sculpting activities, which involve the use of tools, materials, and physical exertion. By enrolling in the course, participants accept the inherent risks associated with these activities, including but not limited to, minor injuries, physical strain, or accidents.

Waiver of Claims

Participants agree to waive any and all claims against Maudie Brady Art, its instructors, and staff for injuries, damages, or losses sustained during the course. This waiver extends to claims arising from ordinary negligence (ie. minor carelessness or mistakes), except in cases of gross negligence or willful misconduct by Maudie Brady Art.

Accident Coverage

Participants are solely responsible for their own health and accident insurance. Maudie Brady Art does not provide medical coverage for participants. Any medical expenses incurred as a result of injuries during the course are the responsibility of the participant. In the event of an emergency, participants authorize us to seek medical assistance on their behalf, and any related costs will be borne by the participant.

Responsibilities in Case of Non-Disclosure

If a participant fails to disclose a disability or medical condition that affects their ability to safely participate in the course and chooses to attend, Maudie Brady Art is not responsible for any resulting injuries, damages, or lack of accommodations. No refunds will be provided under these circumstances.

6. Health and Safety Compliance

Safety Protocols

All participants are required to adhere to the safety protocols provided by the instructor, including guidelines on handling tools, materials, and working within the studio environment. Failure to comply with these instructions may result in removal from the course without a refund.

Equipment Use

Participants are responsible for the correct and safe use of all sculpting tools and materials provided. Any damage to tools, equipment, or studio property resulting from misuse or negligence will be the participant’s responsibility and may incur charges for repairs or replacements.
